A Recent Project
This client is based in the Ebro region of Tarragona province, and needs a Licencia Ambiental in order to open his shooting range. His finca lies within an area of natural interest or ‘PEIN’ (Plan de espacios de interés natural) set out in the Decreto 328/1992.
All activities are classified as categories which are set out within regional regulations, and it is the category of activity which determines the nature of the application procedure. This process is in two stages, with the first stage being an outline submission which asks the authorities in the first place to assess whether a full environmental impact study, Estudio de Impacto Ambiental, is going to be required. This initial submission (sometimes known as a Memoria Ambiental) requires a certain level of information to be submitted:
- The definition, characteristics and location of the project.
- The principle alternatives which were considered and justification for the solution adopted.
- An analysis of the potential areas of impact on the environment.
- Adoption of preventitive or corrective measures in order to adequately protect the environment.
- The proposal of continual assessment to be adopted in order to guarantee the ongoing compliance with adopted measures.
Although not requiring full detail, this first submission should be carefully considered as it can help bypass the requirement for the more in-depth analysis which would be documented in a full Environmental Impact Study, or Estudio de Impacto Ambiental.
It is forwarded via the local town hall or ayuntamiento to the regional environmental department and from there to all departments affected by the proposal, and any objection will need to be addressed within a modification to the project.
If a full environmental study is required, it will again be assessed usually at the level of the ‘comarca’ or ‘county’ in order to verify that its contents are sufficient and correct as well as being compatible with any construction project which accompanies it. If it is then passed, it will be published for 30 days in the official regional online bulletin, in a procedure known as ‘información pública’.
If no further objections are registered, the process is brought to a close by a ‘resolución’ which is made by the town hall. In total, if there are no objections requiring a suspension of the procedure along the way, this process is allowed to take a maximum of 6 months from the first presentation of the application.
This client has already been awarded full authorisation for the security measures adopted for his activity based on a project submitted to the Spanish Guardia Civil whose ‘Intervención Central de Armas y Explosivas’ at the Home Office in Madrid regulate the security procedures for shooting ranges. The drawings here represent extracts from that application which were created in order to justify the layout of the various ‘campos’ within the proposed sequence, and ensure that within a complex landscape, there would be no danger to the public from cartridges or clays while they were on site.
