Legal Searches in Spain

The Land Registry Office or ‘Registro de la Propiedad’ will be able to issue you with a document which is a summary of the deeds of a property and is the key to identifying any irregularities that can present problems during the process of a purchase.

It contains the following information which is critical:

1.The description of the property including details of areas in square metres of a dwelling or of a piece of land. It will identify the property according to its boundaries as well as its full address

2.The names and identification numbers of all of the current owners of the property

3.The status of the property in terms of any outstanding costs (mortgage, municipal taxes etc)

A notary will object to the presence of any outstanding charges existing which figure within the deeds of a property and will demand evidence that the vendor has taken steps to remove any such charge before he will proceed to carry out the property sale transaction.
